Unfortunately, counsel decided to entirely ignore the hearing request submitted by Institutional Shareholder Services, as well as the substantive issues raised by the requests. Counsel chose instead to resort to the empty slights and insinuations used so often by lawyers to cloak the absence any any legal or factual analysis.

Fund Democracy responded to counsel's letter on March 12, 2001. Fund Democracy's response rebuts each of counsel's arguments, and restates the central issue raised by the hearing request: If Hillview truly intends to operate bona fide multimanager funds, then why won't it agree to conditions that would ensure that it did so?
